Terms and Conditions

These Terms and Conditions apply to Dom Tatrzański Ewa, hereinafter referred to as the Facility. The Facility is owned by Magdalena Kłusak Dom Tatrzański Ewa, Salamandra 25, 34-511 Kościelisko, NIP 7361681060, REGON 520632335.

Persons staying in the Facility are hereinafter referred to as Guests.

The person making the reservation at the Facility and issuing the payment for the reservation is hereinafter referred to as the Booker.

I. Basic information:

  1. Making a reservation is tantamount to confirming that you have read these terms and conditions, accept them, and undertake to comply with these provisions, as well as that you read and accept the Personal Data Protection Policy. 
  2. Guests staying at the Facility are also obliged to comply with health and safety and fire protection regulations and, in exceptional situations, to comply with the instructions of the Facility employees.
  3. In the event of a breach of the provisions of these terms and conditions, the Facility has the right to refuse to continue to provide services to Guests who violate them. These persons are obliged to immediately comply with the requests of the employees of the Facility, settle the amounts due for the already provided services, pay for any damage and destruction caused, and immediately leave the premises of the Facility.
  4. By making a reservation, the Reserving Party agrees to the processing of personal data solely for the purpose of making a reservation and fulfilling the registration obligation by the provisions of the Act of August 29, 1997, on the protection of personal data. The Reserving Party has the right to access and update their personal data. 
  5. Reservations are made in the name of the person or company who will make the payment. 
  6. Only persons checked in at the reception of the Facility are authorized to use the Facility. The guest is not allowed to transfer the rented room to other people, even if the period of stay they have paid for has yet to expire. 
  7. For fire safety reasons, it is forbidden to use open fire in the Facility and its surroundings, and in the rooms also: irons, heaters, and other electrical devices that are not part of the room’s equipment. The above does not apply to chargers and power supplies for audio, video, and computer devices.
  8. The Guest bears full material and legal responsibility for any kind of damage or destruction of objects, equipment, and devices of the Facility resulting from their fault or their visitors’ fault. The basis for monetary compensation for damage or destruction is the price list available at the reception of the Facility.
  9. In the event of differences in the inventory of the room equipment and its actual state or in case of its damage, this fact should be reported at the reception directly when occupying the room. Otherwise, it is assumed that the equipment was complete and without damage.
  10. Guests are obliged, in particular, to use the Facility’s equipment in a manner that does not cause damage or deteriorate its condition;
  11. The liability of the Facility for loss or damage to items brought by the Guests to the cottage is regulated by the provisions of Art. 846-849 of the Civil Code. The liability of the Facility is limited if these items are not deposited at the reception desk. The Facility has the right to refuse to accept money, securities, and valuable items, for safekeeping, in particular the valuables and objects having scientific or artistic value, if they threaten the security or are too valuable in relation to their size or standard or take up too much space.
  12. After the end of the stay, the Guest is obliged to report their departure for the purpose of takeover of the room by an employee of the Facility.
  13. The check-in time starts at 3:00 pm and check-out time is at 10:00 am.
  14. Smoking and wearing high heels or shoes that may damage the wooden surface of floors and stairs is strictly prohibited on the premises of the Facility.
  15. Curfew lasts from 10:00 pm to 7.00 am.
  16. Users of the Facility are obliged to behave in a way that does not disturb the peace of other people’s stay in any way during the curfew. During the daytime, the behavior should be in accordance with social norms and respectful of the rights to rest of the people staying on the premises of the Facility.
  17. Persons not checked in may stay at the Facility between 7:00 am and 10:00 pm.
  18. The presence of persons not registered in the Facility after 10:00 pm is tantamount to the consent of the Booker to pay for the accommodation of these persons. Every person will be checked in according to the price of the hotel extra bed from the price list available at the reception or on the Facility’s website.
  19. The facility accepts pets for an additional fee – only after prior arrangement with the facility.
  20. The children and youth under the age of 18 are allowed to stay in the facility only under the care of adults who take full responsibility for their actions, as well as for any consequences of these actions and for the situations occurring on the premises of the Facility. 
  21. The Facility reserves the right to refuse to check in people who are under the visible influence of alcohol or drugs or behave vulgarly.

II. Additional fees:

  1. The price of the stay does not include the local tax charged during registration and transferred to the Municipality’s account, as well as any other additional fees.
  2. The fee for the stay and the local tax of PLN 2.50/person/night is charged on the day of arrival at check-in.
  3. A child up to the age of one (one for two adults) does not incur any fees if he/she sleeps in the same bed.
  4. We accept American Express, Visa, Euro/Mastercard, Diners Club, Maestro.

III. Deposit:

  1. Prepayment in the form of a deposit is required to make a reservation.
  2. Payment of the deposit is tantamount to the Booker’s acceptance of the booking conditions specified in these terms and conditions.
  3. In the case of a non-refundable and flexible offer, the Booker will be charged a deposit of 50% of the total reservation price.
  4. In the case of a non-refundable offer, Booker will be charged a prepayment in the amount of the total value of the reservation at any time.
  5. Failure to pay the deposit within the agreed period results in the cancellation of the reservation.

IV. Resignation:

  1. In the case of a flexible offer, cancellation or change of the reservation up to 30 days before the date of arrival will result in the termination of the contract, and the Facility will not charge the Booker any fees.
  2. In the event of cancellation or changes to the reservation, after the date specified in point 1 or in the event of the Guest’s no-show at the Facility, the Booker will be charged a fee of 50% of the total booking value.
  3. In the case of a non-refundable booking, the Reserving Party will be charged the total price of the reservation in the event of cancellation at any time.
  4. Failure to use the entire stay in accordance with the reservation does not entitle a Guest to a refund of the payment made.

V. Online bookings:

  1. Online bookings are possible via the website domtatrzanski.pl/en
  2. To confirm the reservation, the Booker is obliged to make a payment of 50% of the total reservation value (when choosing a refundable offer) or 100% of the value of the entire reservation (when choosing a non-refundable offer) within one hour of making the booking.
  3. Payment is made through the TPay payment system, available in the reservation panel.
  4. The same cancellation and complaint conditions apply to online reservations and to other forms of reservations. These conditions are specified in Chapters IV and VI of these Terms and Conditions.

VI. Complaint procedure:

  1. Guests have the right to submit complaints regarding the services provided by the Facility.
  2. The Facility accepts only complaints sent electronically to the following address: ewa@turist.pl within 14 days from the Guest’s check out from the Facility or, if the stay did not take place within the period resulting from the reservation made – within 14 days from the date on which the stay should take place.
  3. The Facility reserves 14 days to conduct the complaint handling procedure of the complaint submitted by the Guest. Within this period, the Facility will inform the Guest about the result of the complaint-handling procedure.

VII. Additional information:

  1. Free, unguarded parking is available. You must park in designated areas. The owner of the Facility is not responsible for the car left within the Facility or any property inside it.
  2. Free WiFi is available throughout the facility. 
  3. At your disposal: ski storage room, barbecue facilities (for a fee).
